On June 25, 2021, President Biden issued his "Executive Order on Diversity, Equity, Inclusion, and Accessibility in the Federal Workforce" (EO 14035), mandating that federal agencies reinterpret longstanding merit system principles to place the President's "equity agenda" at the center of all agency decisions. EO 14035 also instructed all federal agencies to "increase the availability and use of diversity, equity, inclusion, ["DEI"] and accessibility training." Other federal agencies, including the Department of Homeland Security, NASA, the National Institutes of Health, the Department of Defense, and the National Endowment for the Arts, have implemented radical new DEI mandatory training materials for their employees, including training regarding "White Fragility," "Heterosexism," "Misogynoir," and "Unconscious Bias." DFI believes the Department of Education has, as instructed by the President, similarly implemented radical new DEI mandatory training for its employees. DFI's request is for records of those DEI training materials and related decision memoranda.
