On March 14, 2022, the U.S. Department of Education published a notice of proposed changes to the Charter School Program that would diminish the independent role and innovative success of charter schools (which have been enormously beneficial to lower-income and minority students) and is counter to Congress's unambiguous statutory intent. In response to a reporter's recent inquiry regarding ED's proposal, ED's spokesperson referred the reporter to the "Network for Public Education Action" ("NPE") (a staunchly anti-charter school advocacy group) and its executive director for further comment on ED's proposed rulemaking. In its FOIA request, DFI seeks records regarding the involvement of NPE and its personnel in ED's Charter School Program proposed rulemaking.
