PRESS RELEASE: Leading Public Interest Law Firms Release Title IX Resource Guide and Host National Webinar as School Districts Face Complex and Hostile Regulatory Landscape
WASHINGTON—As K-12 education leaders across the country face an increasingly complex Title IX regulatory regime, the Defense of Freedom Institute for Policy Studies (DFI), the Wisconsin Institute for Law and Liberty (WILL), and the Southeastern Legal Foundation (SLF) released today a resource guide to assist school boards in navigating the complex requirements of the U.S. Department of Education’s new Title IX regulations. This guide, titled “Protecting Title IX: A Resource Guide for School Boards,” will be accompanied by a national webinar on November 20, 2024, at 1 p.m. ET.
The Biden administration’s Title IX regulations have upended the law’s longstanding guarantee of equal opportunities for women and girls in education and compelled school districts to grapple with numerous compliance challenges.
The in-depth analysis provided by DFI, WILL, and SLF of the new Title IX regulations addresses the complexities posed by these regulatory changes, as well as pending court cases challenging the regulations.
The guide covers vital aspects of the new rule, including the following:
- The implications of the expanded definition of “sex” to include “gender identity.”
- The new, lower standard for harassment and its threats to free speech.
- Parental rights and family engagement.
- The rule’s assault on due process for students and school employees.
Webinar Details: The webinar will provide school board members, school district officials, education policymakers, and stakeholders with practical insights into Title IX’s new regulatory landscape. Attendees will gain access to expert analysis from the Title IX experts at DFI, WILL, and SLF.
Date: November 20, 2024
Time: 1 p.m. ET

DFI’s Senior Counsel Paul Zimmerman said, “While DFI’s fight continues in the courts to overturn the Biden administration’s unlawful regulatory affront to Title IX, this resource offers the information school district officials and administrators need to know about what this radical Title IX rewrite means for their schools. DFI and our allies, like the Wisconsin Institute for Law and Liberty and the Southeastern Legal Foundation, will continue fighting for every school’s ability to protect the privacy and safety of its students, as well as respect constitutional rights to free speech and due process, by combating this harmful rule.”
WILL Education Counsel Cory Brewer stated, “School board members need complete and accurate information—not intimidation. Our Title IX Resource Guide provides an in-depth analysis with essential legal citations to help both new and experienced board members make informed decisions as they adopt policies for their communities. It also explains how the recent changes to Title IX conflict with its original purpose of protecting women and girls from discrimination. This guide will prove to be an invaluable resource nationwide.”
SLF Director Kim Hermann said, “We are proud to lend our voice beside two amazing organizations, Defense of Freedom Institute and Wisconsin Institute for Law and Liberty, to bring this Title IX resource to school board members. As SLF continues to fight alongside its clients Moms for Liberty and Young America’s Foundation to stop Biden’s Title IX immediately in courts, we have come together through webinars and resources like this so people around the country have the resources they need to fight back against these new regulations. We can only truly save Title IX if all people know their rights and are well-informed about the Title IX re-write, and we are glad to be able to play a part of this effort both in and out of the courtroom.”
